Here it is, December 31, 2019. The morning of the last day of the year 2019! Where has time gone and how has it passed us by so quickly?
As we head into the new year, the looming issue of Favors for Friends and ignorance to the borough Rules and Regulations by the officials of the Moosic Borough continue. Water run-off continues to be a problem, an enforcement notice has been received by the property owner on November 13, 2019 however it has not been enforced by the borough. Most recently, an appeal to the Zoning Hearing Board has been made by the property owner to challenge the enforcement notice. What am I missing, what seems to be wrong here?
Per the Borough of Moosic code, section 300-51(B)(3) Enforcement; violations and penalties;
Appeals. Any recipient of a notice of enforcement shall have the right to appeal to the Zoning Hearing Board to remove such notice. Such appeals, however, must be filed with the Zoning Hearing Board not more than five days following the receipt of such an enforcement notice.
Oh, I forgot to mention, the appeal had been received 29 days after the receipt of the enforcement notice! At the guidance of the borough solicitor, the zoning office was to accept the request to appeal and have it sent to the ZHB for an appeal meeting to be set up. Unless I misunderstand the borough code as written, the property owner had 5 days to file and appeal, not 30! The solicitor had been questioned about this however insists they had 30 days to file.
Has it been said…. Favors for Friends, Ignorance to borough Rules and Regulations? It’s time for a change, elected official should represent all constituents of the borough, not just friends and donors!
